1. About these terms
These Terms of Use apply to The Thoroughbred public website and mobile application, including registered accounts, Free features and, where and when it is offered, The Thoroughbred Elite subscription service.
The Thoroughbred is operated by Diablo Aquila Ltd, a private limited company registered in England and Wales under company number 17010899, with registered office at 12 Rosehip Lane, Tunbridge Wells, United Kingdom, TN2 3XU.
By using The Thoroughbred or creating a registered account, and by purchasing Elite if it is made available, you agree to these terms to the extent they apply to the service you use. Mandatory consumer rights that cannot lawfully be excluded or limited are unaffected.
2. Accounts and eligibility
Some parts of The Thoroughbred can be used without a registered account. Account-linked features and Elite require an authenticated registered account.
You are responsible for keeping your sign-in details secure and for activity carried out through your account. Do not share account credentials or deliberately allow another person to use an entitlement that is licensed or verified for your account.
Users under 13 are not permitted to create a registered Thoroughbred account under the current product rules and may use only the guest experience made available to them. If you are aged 13–17, you should use The Thoroughbred with the knowledge and permission of a parent or guardian where appropriate. Any paid subscription must be authorised by the holder of the relevant Apple App Store or Google Play account and payment method.
You must provide information that is reasonably accurate where the service requires it and must not impersonate another person or misuse another person's account.
3. Free and Elite
The Thoroughbred provides a Free service and may make selected additional features, deeper research or limited sample content available without payment.
The Thoroughbred Elite is a planned optional paid subscription designed for users who want deeper horse-racing analysis, research, personal organisation and related premium features. The product principle is: Go deeper. Keep the uncertainty.
Elite is not currently available for purchase and is not included in the invite-only Android beta beginning 5 October 2026. The subscription provisions below apply only if and when Elite is made available.
Elite does not replace the Free service. A paid subscription is not required to use the Free features that The Thoroughbred makes available without payment.
Elite features may develop over time as the product, racing calendar, data rights and technical capabilities evolve. We will not deliberately remove the substance of a paid subscription during a paid period without a legitimate product, legal, rights, security or technical reason, and any material subscription change will be handled consistently with applicable store rules and consumer law.
4. Planned founding subscription price
The current planned UK founding offer is Elite Monthly — £3.99 per month once the first paid Elite package is ready and validated.
No annual Elite plan is required for the founding launch. An annual option or a later new-subscriber price may be introduced only after a further product and pricing decision.
If Elite Monthly launches on these terms, it would be an auto-renewing subscription.
The actual price that applies to your purchase is the localized price displayed by the Apple App Store or Google Play immediately before you confirm the transaction. Storefront prices can vary by territory, currency, tax treatment or later approved price changes. If the store displays a different valid price from the standard UK price above, the store price shown before confirmation is the price applicable to that transaction.
No conventional launch free trial is currently offered unless the purchase screen and relevant app store expressly state otherwise. If a trial, introductory offer or other promotion is introduced later, its duration, price and conversion/renewal terms must be shown before purchase.
5. Apple App Store, Google Play and subscription infrastructure
If Elite is offered for purchase in the mobile app, subscriptions will be transacted through the Apple App Store or Google Play, depending on your device and storefront. The relevant store handles the payment transaction, payment method, charging and store-level subscription management under its own purchasing terms.
The Thoroughbred does not directly receive or store your full Apple or Google payment-card details.
If Elite launches with a specialist subscription or entitlement provider, that provider may help receive and reconcile information from the app stores about purchases, renewals and entitlement state. Any such provider would support entitlement verification rather than replace the relevant app store as the store billing mechanism.
When Elite purchasing is available, after a purchase or restore The Thoroughbred will verify the subscription against its server-side account and entitlement rules. A store transaction alone does not require us to unlock Elite if a valid current entitlement cannot yet be verified. If verification is temporarily unavailable after a valid store purchase, the transaction is not treated as lost and the app provides a Restore purchases/reconciliation route.
6. Automatic renewal
If Elite launches on the planned founding subscription model, Elite Monthly will renew on a monthly basis unless cancelled through the relevant store before the next renewal takes effect.
The store will charge the payment method associated with the purchasing store account according to the price and renewal information it displays and its applicable rules. If a subscription price changes, any required store notice, consent or other process will apply before the changed price takes effect where required.
7. Managing and cancelling a subscription
If you purchase Elite when it becomes available, you will be able to manage or cancel the subscription through the app's subscription-management route and the subscription settings of the store account that purchased it.
For Apple purchases, subscription billing is managed through the Apple App Store. For Google Play purchases, subscription billing is managed through Google Play.
Cancellation normally prevents a future renewal rather than immediately removing access already paid for. Access will ordinarily remain until the end of the then-current paid period, subject to the relevant store's rules, any refund or revocation and any mandatory consumer right that applies in your location.
When Elite purchasing is enabled, the app will provide an easy route to manage or cancel the store subscription. Removing the app from your device will not cancel a subscription.
8. Billing retry, grace periods, expiry and revocation
If a renewal payment fails, Apple or Google may apply billing-retry, grace, account-hold or similar states according to the store configuration and its current rules.
Where the relevant store continues the subscription entitlement during an applicable billing grace period, The Thoroughbred will continue to provide the corresponding Elite access while that entitlement remains valid and is verified by our service.
If the store reports that the entitlement has expired, entered a state that does not carry access, been refunded, revoked or otherwise ceased to be valid, The Thoroughbred may suspend or remove Elite access. Your registered account can remain as a Free account unless you separately delete it.
We do not promise a fixed grace or retry duration because those states and durations can be controlled or changed by the relevant store.
9. Restore purchases and entitlement reconciliation
When Elite purchasing is enabled, the app will provide a Restore purchases function so an authenticated user can ask the relevant store and subscription infrastructure to re-check eligible purchases.
Restore purchases does not create a new paid subscription and is not a guarantee that a particular account will receive Elite. Access depends on a valid store purchase being capable of being associated with the authenticated Thoroughbred account and passing the service's entitlement verification.
If you use more than one Thoroughbred account, do not deliberately attempt to duplicate or share one paid entitlement across unrelated accounts. Store and entitlement-provider identity or transfer behaviour may affect which account is associated with a restored entitlement.
10. Refunds and consumer cancellation rights
Refund requests for Apple App Store or Google Play transactions are normally initiated through the relevant store and are subject to its refund processes and applicable law.
Nothing in these terms removes any statutory cancellation, refund, quality or other consumer right that applies to you. Where applicable law gives you rights that are more favourable than these terms or a store's general policy, those mandatory rights continue to apply.
11. Account deletion and subscription cancellation are separate
You can permanently delete a registered Thoroughbred account through the Account area of the app. An external account-deletion route is also available through The Thoroughbred website for users who cannot access the app.
Deleting a The Thoroughbred account does not automatically cancel an Apple App Store or Google Play subscription.
If you do not want future charges, you must cancel the store subscription through the Apple App Store or Google Play account that purchased it. The app gives users an opportunity to open store subscription management before deleting the account, but account deletion is not made conditional on cancellation.
When a Thoroughbred account deletion is successfully completed, account data under our control that is no longer lawfully required is deleted in accordance with the Privacy Notice. The current deletion flow also removes private Wallet documents associated with the account.
If future subscription infrastructure holds account-linked entitlement data, its treatment on account deletion will follow the Privacy Notice and the provider and legal requirements in force at that time. Apple or Google may continue to hold transaction and store-account records under their own terms and legal obligations after the Thoroughbred account has been deleted.
12. Racing analysis: evidence, not certainty
The Thoroughbred and Elite are horse-racing information, analysis, research and organisation products.
The Thoroughbred is not a bookmaker, does not accept bets, does not provide staking instructions and does not sell guaranteed predictions. Elite is not a tipping service.
Analysis may identify factors that support or count against a horse, describe race shape, compare evidence or express an analytical preference. That is not a promise of an outcome. Horse racing is inherently uncertain and the service is deliberately designed to keep uncertainty visible.
Any feature such as a recorded analytical view, race assessment or The Thoroughbred's Choice is an expression of analysis within the product framework, not a direction to place a bet, a claimed certainty or a guarantee of profit.
If you independently choose to gamble, that decision is outside the service provided by The Thoroughbred and remains your responsibility. Nothing in The Thoroughbred should be treated as financial advice or as a substitute for your own judgement.
13. Racing information and data availability
Racecards, declarations, results, form, ratings, course information, derived analysis and other racing information can change, be corrected, be delayed or occasionally contain an error or omission.
We take reasonable steps to use reliable sources and to distinguish source information, calculation, interpretation and uncertainty, but we do not guarantee that every item of racing information will be uninterrupted, complete, current or error-free at every moment.
A race can be abandoned, rescheduled or changed, a runner can be withdrawn and third-party source information can be updated after it first appears in the service.
14. Private information and user-supplied content
The Thoroughbred lets registered users save private information such as notes, follows, lists, Race Day plans and, where supported, documents or booking information in Wallet.
You retain your rights in information or documents you lawfully upload. You give Diablo Aquila Ltd the limited permission necessary to host, process, back up, transmit and display that content to you for the purpose of operating the requested feature.
Do not upload content you do not have the right to use, unlawful material, malicious files or unnecessary highly sensitive personal information. Private storage features are not intended to be a general-purpose archive for irreplaceable documents, and you remain responsible for retaining any original document you need independently of the app.
15. Acceptable use
You must not:
- misuse, attack, overload or deliberately interfere with the service or its security;
- attempt to gain unauthorized access to another user's account or private data;
- scrape, systematically extract, resell or republish protected service data or content except where law expressly permits it;
- reverse engineer or circumvent access, entitlement, rate-limit or security controls except to the extent a mandatory law expressly allows;
- use automated means to create abusive traffic or false accounts;
- use The Thoroughbred for unlawful, fraudulent or infringing activity; or
- deliberately manipulate subscription, restore or account systems to obtain paid access without a valid entitlement.
We may take proportionate action to protect the service where misuse is detected.
16. Third-party services and affiliate links
The Thoroughbred may link to racecourses, travel providers, ticket or hospitality providers, retailers, app stores and other third parties. A third party controls its own website, availability, prices, terms, privacy practices, fulfilment and customer service.
Some clearly identified links may be affiliate links. Diablo Aquila Ltd may receive a commission if a qualifying transaction is attributed to such a link. Commercial relationships do not purchase favourable racing analysis or a guaranteed position in editorial/research conclusions.
The Thoroughbred does not become the seller of a third-party ticket, hotel, journey, product or other external service merely because a link is shown in the app or website.
17. Intellectual property
The Thoroughbred name, branding, software, interface, original editorial material, analytical presentation and other proprietary content are owned by or licensed to Diablo Aquila Ltd unless stated otherwise. Third-party racing data, marks and content remain subject to the rights of their respective owners.
You may use the service for your personal, non-commercial use. These terms do not transfer ownership of The Thoroughbred or its underlying intellectual property to you.
18. Availability and service changes
We may maintain, update, improve, replace or discontinue individual features where reasonably necessary for product development, security, provider changes, data rights, technical reliability or legal compliance.
We do not guarantee uninterrupted availability. Planned or emergency maintenance, provider outages, app-store issues, network failures or circumstances outside our reasonable control can temporarily affect the service.
Where a change materially affects an active paid subscription, we will act consistently with applicable consumer law and relevant Apple/Google requirements.
19. Suspension or termination
We may suspend or restrict an account where reasonably necessary to investigate material misuse, protect users or systems, comply with law or address a serious breach of these terms. Where appropriate, we will act proportionately and provide information about the reason or available next step.
An expired or invalid Elite entitlement can be reduced to Free access without deleting the underlying Thoroughbred account.
You can stop using The Thoroughbred at any time. Account deletion and subscription cancellation are separate processes as explained above.
20. Liability and consumer rights
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, or any mandatory consumer right.
The Thoroughbred is supplied for personal consumer use. We are responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill, subject to applicable law.
We are not responsible for a third party's independent service, for losses caused solely by information or conduct outside our reasonable control, or for a racing or betting loss arising from an independent decision to gamble despite the service not being supplied as betting or staking advice, except where applicable law requires otherwise.
21. Changes to these terms
We may update these terms when the product, Elite subscription, providers, store rules or legal requirements change. If a change is material to an active account or paid service, we will provide appropriate notice where required.
A subscription price change is also subject to the relevant app store's notification and consent rules where applicable.
22. Governing law and contact
These terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply where you live. Nothing in this clause prevents you from using a court or consumer remedy that applicable law makes available to you.
